Wild Apple General Store Terms & Conditions
This agreement (the "Terms") governs your use of our online store (the "Service"). By placing an order, you agree to these terms.
1. Introduction and Scope
This website is operated by the "Company" ("we", "us", or "our"). We offer an online retail platform featuring both hand crafted items crafted by us or independent artisans, and goods fulfilled via third-party dropshipping suppliers.
2. Product Variations and Custom Orders
-
Handmade Items: You acknowledge that hand crafted goods are unique. They may exhibit slight variations in color, size, texture, and finish. These variations are characteristics of artisan craftsmanship, not product defects.
-
Custom and Personalized Orders: All sales are final for custom-made, personalized, or modified goods. Production on custom orders begins immediately upon payment clearance. Once production starts, custom orders cannot be cancelled, modified, or refunded.
-
Dropshipped Items: Product descriptions, specifications, and images for dropshipped goods are provided by third-party suppliers. We make every effort to display accurate details but do not warrant that descriptions are completely error-free.
3. Pricing, Taxes, and Payment
-
All prices are listed in Canadian Dollars (CAD) unless specified otherwise and are subject to change without notice.
-
Orders shipped to Canadian addresses are subject to applicable provincial taxes, including the Harmonized Sales Tax (HST) or Goods and Services Tax (GST) based on the destination province.
-
We reserve the right to refuse or cancel any order if a product is listed at an incorrect price due to a typographical or supplier error. If your payment method has already been charged, we will issue a full refund immediately.
4. Shipping, Delivery, and Custom Duties
-
Flat-Rate Shipping: Shipping fees are charged at a flat rate per order or per item category as indicated at checkout. Flat rates are subject to change without notice.
-
Split Shipments: Because we utilize both local artisan studios and international dropshipping suppliers, items in a single order may ship separately and arrive at different times in different packaging.
-
Delivery Estimates: Shipping timeframes are estimates, not guaranteed delivery dates. Dropshipped goods may face extended customs clearance delays.
-
Import Duties and Taxes: Customers located outside the shipping point origin are responsible for all customs fees, import duties, or local taxes. We are not liable for packages seized or delayed by customs authorities.
5. Return and Refund Policy
-
Handmade Goods: Standard handmade items may be returned within 30 days of delivery if they are unused and in original packaging. As stated in Section 2, custom-made or personalized goods are strictly non-returnable.
-
Dropshipped Goods: Returns for dropshipped products must comply with our specific Return Merchandise Authorization (RMA) process. Do not return items to the address listed on the shipping label; contact customer service for the correct Canadian return depot address.
-
Damaged Goods: If an item arrives damaged, you must notify us within 48 hours of delivery with photographic proof of the item and packaging to qualify for a replacement or refund.
6. Limitation of Liability
To the maximum extent permitted by the laws of Ontario, the Company shall not be liable for any indirect, incidental, or consequential damages resulting from the use of, or inability to use, our products. Our maximum liability to you for any product purchase shall not exceed the actual purchase price paid by you for that specific item.
7. Intellectual Property
All content on this site—including text, graphics, logos, images, and handmade product designs—is the property of the Company or its content creators and is protected by Canadian and international copyright laws. You may not copy or redistribute this content without express written consent.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law provisions. Any legal action or proceeding relating to your access to, or use of, the website or products shall be instituted in a court in Ontario.
